Age 78 years, NSW Death Reg. No. 5116/1890. Cause of death Diaorrhea and Asthma. Buried 27th November, 1890, at Forbes, NSW. grave is not marked and not identifiable. 1837 - Assigned to Master Thomas Kyle (Kite), Disrict Bathurst, NSW. Information source - General Return of Convicts in NSW 1837, Entry 2094, page number 50. 1841 - 21st June. Ticket of Leave Granted, Ticket No.41/1204. Allowed to stay in Bathurst District. 1846 - 19th February Passport for permission to leave Bathurst district and travel to Lachlan River District droving cattle. - Married when ? to Margaret ? 1860 - 1st Child Ann Victoria was born at 'Geeron' (Station?), Condobolin, NSW. Made out his will in favour of his friend Charles Smith McPhillamy owner of Warroo Station. This is the last Will and Testament of one Henry Bourne of Warroo, I appoint Charles S. McPhillamy of Warroo to be my Executor and direct that all my just debt and funeral and testamentary expenses shall be paid as soon as conveniently may be after my decease. I give, devise and bequeath unto Charles Smith McPhillamy of Warroo all my right, title and interest in my conditional purchase and conditional lease being C.P. 84.45 and C.L. thereto to the said Charles Smith McPhillamy of Warroo in consideration of his great kindness towards me during the past few years; and the residue of my personal estate I give, devise and bequeath to my daughter Clara Bourne. In witness there of I, the said Henry Bourne have, to this my last Will and Testament set my hand this twenty fifth day of November, in the year of our Lord, One thousand eight hundred and ninety. Sidney Jones Mary Ann Cavanagh 25th November, 1890, The day that Henry Bourne made his will was the same day that Henry Bourne died. 16th January 1891 By Act of Court Probate of the Will of the above named deceased was granted to Charles Smith McPhillamy of Warroo Lachlan River Grazier the Executor in said Will named. Testator died 25th November 1890. Estate sworn under 819 pound. Bathurst was founded at the terminus of Cox's Road on the orders of Governor Lachlan Macquarie who selected the site on 7 May 1815, and is the oldest inland town in Australia. The name Bathurst comes from the surname of the British Colonial Secretary Lord Bathurst. It was intended to be the administrative centre of the western plains of New South Wales where orderly colonial settlement was planned. The initial settlement of Bathurst was on the eastern side of the river in 1816. It is in today's suburb of Kelso. Each of 10 men were granted 50 acres (20 ha), five were men new born in the colony and five were immigrants. These men were William Lee, Richard Mills, Thomas Kite, Thomas Swanbrooke, George Cheshire, John Abbott, John Blackman, James Blackman, John Neville and John Godden. In 1818 Governor Lachlan Macquarie stated in his diary: This morning I inspected 10 new settlers for Bathurst. I have agreed to grant each 50 acres of land, a servant, a cow, four bushels (141 litres) of wheat, an allotment in the new town, and to provide for them for 12 months from the King's stores.
