Convict Notes




James Brien, a very ill-looking fellow, was put forward, charged with taking a gun, the property of the Rev. Nicholas Herbert, near New-Inn. The Rev. N. Herbert sworn—l live at New Inn; I was shooting near my house in January, 1841; a policeman joined me; I had fired at a snipe and went to pick him up; some little boys who followed said, here are more fowlers coming;” I looked in the direction and saw three men armed advancing; I presented and they presented; they said they would have life if I did not give up my gun; I said perhaps I would have one of them down first; they then shed on me and I surrendered at discretion (laughter); I could not identify any of them. Mr. Rolleston—Were you afraid Mr. Herbert that day. Mr. Herbert—l cannot say I was, but I did not feel very comfortable (laughter). Sgt Constable Cotter sworn—l was with the Rev. Mr. Herbert the day his gun was taken; the prisoner the man who took the powder horn out of his pocket; I had his shot pouch, and one of them swore he’d blow my bowels out, if I did not give up the pouch. Cross examined by Mr. Rolleston—l swore to to a man charged with this offence before, and he was acquitted. Waterford Chronicle, 30 July 1842. James Byrne was then given in charge for having robbed the Rev. Nicholas Herbert of his gun, at New Inn, in the month of January. 1841. The jury repaired, and in a short time returned with a verdict of guilty. Waterford Chronicle, 30 July 1842.
