Gloucester Assizes, Aug 31. James Bubb, aged 39, was convicted of stealing was convicted of stealing a 51. note and some shillings out of the pocket of John Davis. It appealed that Davis had been treating the Prisoner with some drink, and at last himself became quite drunk; the Prisoner at the same time was at great pains to keep himself sober, and took the opportunity stealing the money from his drunken benefactor. The girl in the public house saw the public-house the Prisoner's hand in Davis's pocket, and part of the money was found upon him. The Prisoner is a comfortable looking man, and received a very good character from respectable innkeepers, whom he had had served as coachman. The Jury recommended him to mercy. Mr. Baron Garrow said, that there, could scarcely be case more aggravated than the prisoner's. Till lately the offence was capital ; were it so still, he should not be the Judge that would in this instance recommend any mitigation. To the Jury the Prisoner owed reduction of seven years in the period for which he watt to transported. The sentence of the Court was, that should be transported for 14 years. The Prosecutor applied for his expenses in vain, And was Severely reprimanded for his drunkenness and misconduct. Charles Webb, aged 27, was ignored as to rape, but put upon his trial for assault New Times, 4 Sep 1818. Note. There are several accounts of this case in a variety of newspapers, and many use the name James Bubb, probably a misreading of Bush. His age also varies in different accounts, from 32, 39, even 52.

James Bush was one of my greatx4 grandfathers. He was born in Bitton, Gloucestershire and married Sarah Jefferis in 1806. After arriving in Sydney he was sent to Newcastle but was incarcerated in Newcastle gaol on at least two occasions. He is known to be alive on 18th March 1836 when he was released from the gaol. In the 1851 UK census his wife Sarah is listed as a widow although whether this was confirmed to her or whether it was guessed at is uncertain.
