Convict Notes


James was tried at Meath on the 7th February 1838 with stealing the gun.. He was sentenced to 15 years transportation. He arrived in Australia on the ship Elphinstone on the 29th December 1838 and was assigned to Alexander Park of Lewinsbrook near Paterson in the New South Wales Hunter Valley. He received his Ticket of Leave, No: 45/75 on the 11th January 1845 and was allowed to remain in the district of Paterson, NSW. In 1849 he was reunited with his wife and several children upon their arrival to Australia on the ship Panama. There were no records located to indicate when he received his pardon, however his 15 year sentence expired in 1853. One year later he was sentenced to 18 months hard labour and imprisoned in Parramatta Gaol for assaulting Edward Rusden with a reaping hook on the 11th December 1854.


Cunningham (with Luke Hogg, Daniel Gilligan, and Patrick Traynor) set off towards the Fair of Kilbeggan intending to rob anyone they met on the way. The came across Mr Webb and knocked him down and took money and a gun from him. On 13 Dec 1837 Cunningham (with Jack Shaugness, Ballivor Jack Bligh and a stranger) used the gun to kill Mr Nugent's sheep, they left the skin and bones but carried away the wool and meat.
