Owen Glynn, John Claffy, and John Daly, on the of the 13th April, and others, (one of them being armed,) forcibly entered the dwelling house of John Costello, and feloniously carried away a quantity of notes and silver. Westmeath Guardian, 14 July 1842. John Claffy, John Daly, and Owen Glynn, burglary and felony; each to be transported for 15 years. Westmeath Guardian, 28 July 1842. Westmeath Assizes. ROBBERY. John Claffy and two others were indicted for robbery. John Costello sworn—and examined by Mr. Clarke—Lived at Boyannagh on the 14th April ; had upwards of ? that night, all in silver £3 ; had it at the head of his bed in a crock ; recollects that five persons came to his that night and broke in the door. there was good light in the house; they knocked the girl down, and covered her ; they then came to witness and pulled him out of his bed and threw him out of the door ; [identifies prisoners]—John CIA* pointed a pistol at the girl ; John Daly stood at the door ; knew him before ; he had a handkerchief on head ; they searched the house and broke the chest ; John Daly took the crock with the ; he knew where it was ; information some time after he recovered. Cross-examined by Mr. Gorman, been ill of a fever ; was confined to bed about 21 days before the robbery ; had two girls tending him, Bridget Gallagher and Mary DeWitt ; had Jane Fallen for a days ; Bridget Gallagher knew where the money was ; it was concealed in old blind window ; he willed the money to the ; the women refused to give it ...; Jane Fallon was put out of the house; Glynn advised him to put her out of the house; his aunt came to visit him ; sent her away in a few days ; his friends said they ought to get the money instead of she ; saw Daly three days after the robbery, before he lodged informations; was well able to walk about half a mile ; swore against Daly and that day. Bridget Gallaher, sworn and examined by Mr. Corbally.—Knows last witness ; lived in his house last April ; saw the money in four days before the robbery ; recollects some men coming to the house about 12 o'clock ; they ... the door off the hinges ; four men came first, then another ; one of them struck witness with a b..y handle ; witness shouted, when one of them armed with a pistol and swore he'd shoot her if she did hold her tongue ; they then covered her with a quilt, held her down ; saw no more ; looked for the money after they left the house ; it was gone; there was a good fire [identifies J. Daly, and Owen Glynn] ; saw them two days before the robbery at the door. Cross-examined.—Saw the money before the robbery ; never knew that day where it was; was in the King's county when the Will was made ; witnesses sister came to her while at the house ; was then ten days before the robbery ; came to see the patient ; always hoped he'd recover ; Mary Doolan, and two women was with her; one of them was Jane Fallon ; the priest came to look for the money before !he robbers ; the patient was willing he should get money ; witness would give the priest the money it she knew where it was; he asked for the money two days before the robbery ; the women said they did not know where the money was. Mary Doolan sworn and examined by Mr. Clarke—Was in the house of Costello when it was robbed ; was not able to know any of the men. John Delany, Constable, sworn and examined by Mr. Clarke—M. Dolan, one of the women, came to witness about one o'clock at night; arrested two of the prisoners on the 14th ; sworn informations were lodged again. , prisoners on the f?Rtb by ….. Cross-examined by Mr. Gorman—Found no…. house of the robbery ; in ; did not a 4; him u of the robbery ; Mr. Fallon and the were in the time. _ Mr. Frallon, Inspector, sworn—Went to Costello's house on the I4th ; he was ill in bed ; on the 28th he swore his informations….. Rev. Mr. Murray sworn and examined —ls a Roman Catholic clergyman ; knows John Costello; had occasion to see him when ill , he complained (in his delirium) of the people about him having treated him badly ; it was the day before the robbery, Costello wished to give the money to witness, but witness did not wish to have anything to do with it; witness advised Costello to make his will ; Costello told witness on the day after the robbery that he was not sure of prisoners. Cross-examined by Mr. Clarke—Costello told witness a few days after the robbery that he knew the prisoners ; Costello made a will on the 4th of April; saw him on the Friday after the robbery ; he was weak ; witness got the will. Bridget Gallagher re sworn—Had a conversation with Owen Murray after the robbery it is not long ago ; mentioned Glynn's name to ; said he had a right to disguise himself that she might not know him. Owen Murray, sworn—Heard what Bridget Gallagher has sworn with respect to Glynn ; she told witness was not sure of Glynn. Mr. Charles Adamson, Mr. J. Moran, and Mr. G. Smith (a juror), gave Glynn a character. Verdict—guilty. Westmeath Guardian, 21 July 1842
