Joseph Foots was Baptised on 31.12.1820 at St.John the Baptist Church in the Parish of Sedlescombe County of East Sussex (report supplied by Sussex Family History Group) and he died on or about 15.10.1865 according to his death certificate, an accurate date could not be supplied as he died on the ranges about 1 1/2 miles from Howqua Station, he was found in a decaying state.




Joseph Foots was my g.g.grandfather, he arrived in Hobart on the convict ship "Susan" on 21.11.1837 with his brother Stephen - Joseph was 17 and Stephen 19 - they were convicted of stealing a crock containing 17 pounds of butter and a piece of pork. They were sentenced to seven years transportation to Van Diemens Land, and shipped out from London to arrive in Hobart. In the context of the times, their offence was probably because of starvation, and their sentence of transportation was simply a strategy for relieving population pressures in England and populating the colonies. Joseph Foots, the great grandfather of Sir James Foots, was a 17 year old farm labourer and ploughman - he was described as 166cm, sallow complextion, dark brown hair, and grey eyes, with a medium nose. Joseph was given his Ticket Of Leave on 15.7.1842 and Certificate on on 23.4.1853. They probably crossed to Victoria after gold was discovered. On 15.11.1853 in Melbourne, Joseph married 16 y.o. Sophia Dellar (Sophy Dellir - shown on marriage cert.) Joseph and Sophia moved away from Melbourne, and the locations at which children were born to them before 1857 are unrecorded. At the Magistrates inquiry touching the death of Joseph Foots, held at the Courthouse Jamieson on the 1st day of January 1866, before John Nicholson and H.A. Bergess Esq. JP. Stephen Foots, being duly sworn faith as follows; I am a Hotel Keeper and reside at Mountain Track near Jamieson, I have seen the body of the deceased which was shown to me by and I recognize it to be that of Joseph Foots, my brother. I first saw the body on Saturday the 30th December 1865 on the ranges about one mile and a half from Howqua Station. The body was lying on its back with the arms and legs stretched out. I could not recognize the features but knew it to be my brother by a mark in the teeth on the right side. I also recognized the spurs and the shirt that he wore, as well as the hat and saddles which were found near him; I last saw him alive ten weeks ago, last Thursday, he was then about to start for Mt Chenery Station after which he was going to Mt Tomkins for a mare and a pack saddle. He was forty three years of age; married to Sophia Deller in Melbourne and has four children. He was born in England in the parish of Ashburton in the county of Sussex, and has been twenty four years in the Australian Colonies, Seven years in New South Wales and the remainder of the time in Victoria.
