1840 - 3 August 1840. TRIAL; Sydney Australasian Chronicle. Tue 4 Aug 1840, Page 3 Supreme Court. John Gallagher, of Penrith, for cattle stealing from John Roberts, of Windsor, on the I1th May, pleaded- guilty. The Chief Justice enquired of the prisoner whether he was aware that by so doing he would not benefit himself, as the judge could still be obliged to pass the sentence of the law upon him. The prisoner answered that he did it of his own free will, and under a full knowledge of the consequences............ The punishment for this crime had lately been altered, and it was fortunate for the prisoner that it had been so modified, or he would inevitably have expiated his crime upon the scaffold Sentenced fifteen years transportation to a penal settlement.
