John Luke and Robert Hayes were indicted for stealing on the 17th of September last, one and three-quarter yards of superfine cloth, value two pounds, the property of Michael McNamara, Sydney. It appeared from the evidence, that the prisoner Hayes worked with the prosecutor. On the evening of the day laid in the indictment, prosecutor left his house and locked the door; upon his return he missed the cloth; suspecting Hayes, he went the following morning to where he lodged; Luke then told him (prosecutor) where the cloth was, and that he had been concerned in the robbery. - Guilty. Remanded. Sydney Monitor, 7 Nov 1835. John Luke and Robert Hayes, convicted of a burglary in the dwelling-home of Michael Macnamarra, of Sydney. Judgment of death recorded.
