Text type Trial account Defendants JOHN JOHNSON, FRANCIS POPE Offences Theft > Grand larceny Session Date 13th April 1791 Reference Number t17910413-32 Verdicts Guilty, Not guilty Punishments Transportation 175. JOHN JOHNSON and FRANCIS POPE were indicted for feloniously stealing, on the 4th of March last, two pair of leather shoes, value 2 s. two pair of leather shoes, value 6 d. a pair of leather half boots, value 12 d. the goods of James Bothway . JAMES BOTHWAY sworn. I am a shoemaker , I lost these things from Rathbone place , I was called up by one of the watch, and he told me my place was broke open, and that they had got two men in custody. JOHN HAYES sworn. On the 4th of March last I was coming from the watch-house, about a quarter before six, I saw these two men coming as from Mr. Bothway's shop, at the end of Percy-street; I told the watchman to stop them with me; we did, and coming up we found Mr. Bothway's place broke open, and we found upon them in their pocket the shoes; they were all in the pocket of Johnson; nothing was found upon Pope but a knife. CORNELIUS BIRKITT sworn. I stopped the two men with Hayes, Johnson had the half-boots which he dropped, and an iron crow, and the shoes in his pocket on he other side; I do not know Pope had any thing. JOSEPH WHITEMAN sworn. Corroborated Hayes and Birkitt's testimony. PRISONER JOHNSON's DEFENCE. I picked them up. PRISONER POPE's DEFENCE. At the time I was apprehended, I was five or six yards from this man; I know nothing of them. (The shoes produced and deposed to.) JOHN JOHNSON , GUILTY . Transported for seven years . FRANCIS POPE , NOT GUILTY . Tried by the first Middlesex Jury before Mr. Baron HOTHAM .
