Tyrone Assizes, Omagh, March 23. James Lockart, for burglariously entering the shop of Patrick Gartland, with intent to steal and carry away therefrom, at Augher, on 25th Dec. last. Patrick Gartland, examined by Counsellor Smyly—Lives in Augher, and keeps a shop there, which is part of his dwellinghouse; his sleeping room is nearly over the shop; recollects Cbristmas-eve, the night of the 24 Dec. last; closed his shop that night about eleven o’clock, and fastened the windows with iron bars, also the door afterwards went to bed, and about three or four hours before day was alarmed by Nicholas Reid and a boy of his own; rose up and went down the shop, and discovered that pane of glass above the door had been broken one of the window shutters was off, and large pane of that window also broken; looked through the shop, with a candle in his hand and found the prisoner, whom identifies, lying under the counter, on which there was a hide of leather; sent for the police, and gave him into their custody; the glass was not broken when he went bed ; cannot say that any thing was taken. Nicholas Reid—Lived in Augber Dec. last, an apprentice to a surgeon there; it was opposite the prosecutor’s house; recollects the morning of Dec.; about three o’clock heard a noise in the street while in bed ; rose up, and came to the front window, and saw that Mr. Gartland’s window had been broken; there was a man standing at one of them ; awoke the servant boy, and proceeded over the street ; found the shop as described; the moment he went out the man he saw the window ran off; thinks there were others an entry; when the shop was opened, entered it, and there found the prisoner, who called himself James Lockart; identifies him; remained the window, after having given the alarm, until Mr. Gartland came down; during the time stood at it, heard some person inside moving the bar the shop door; called out that the robbers were inside; a shop boy requested him to stop at the door until would bring down the family, and while he stood prisoner came to the broken pane in the window, but he prevented him from coming out; was given in charge to the police, and a comb was found in his pocket. James Lockhard was indicted for the wilful murder of Murdoch Campbell, Esq; by shooting him with a gun loaded with powder and a leaden bullet on the left side of the head, near the left eye, at Upper Minto, on the 15th January. Registrar How say you, are you guilty or not guilty ? Lockhard. Unless the money is returned to me that was taken away, I won't say a busy word. James Lockhard - 4 February 1833 - Hanged at Sydney for the murder of Murdoch Campbell in the Narellan area.
