John and Wm. Tuuhy, Pat. Hogan, Denis and Michael Mark, were tried for a burglary and felony in the dwelling -house of William Walsh, of Lisbonny. Wm. Walsh stated that his house was broken into between twelve and one o'clock at night by a party of men ... ...  Judith Walsh, wife to the last witness, identified Denis and Michael Mack, as the two persons promised to allow the party to do harm to her family. The party took half crowns out her pockets, which they found under the pillow they also took her husband’s coat and waistcoat, and the “gallows” out of his small clothes—also lump of sugar, Mary Hogan, servant Walsh, for the defence, deposed that the Macks were not of the party who broke into her master’s house; knew them  before; did not know any of the party that night. Cross-examined by Mr Scott—One of the Macks passed me by next morning, while milking the cows we saluted each other. I got into my master’s room before the door was broken. Denis  Hogan swore alibi for the Macks. Daniel Kennedy corroborated the testimony of the preceding witness. Winoy Scales proved  proved an alibi for the Tuohys, to one of whom her sister was married. Did you get your rest well.’ No, indeed, Lord. I was awake most of the night, The bed being strange one (laughter). Court —Why, then really you look as if you got your rest well—it would hard for me if I did not rest in strange bed, travelling about the country. Guilty of the felony. The Court addressed the prisoners briefly, explaining to them the leniency that had been exercised towards them by the Jury. They belonged to a party who went about the country robbing for arms. After few observations  be adjudged them severally to seven years transportation. Here one of the prisoners exclaimed loudly well, the contents of this book (kissing prayer book which he held in his hand), had neither hand, act, or part in the crime swore against me here to day. The same disgusting exhibition was gone through the other prisoners  each swearing that he was innocent —after which one of them cried out—we have  one request, Lord, and may you would not refuse it, will you give us copy of the date of our committal? The entire gang were removed from the dock with difficulty—nor was there second opinion their guilt- They were well dressed, and appeared to belong to the class of respectable farmers. It was stated by Mr. Scott, Counsel for the Crown, that the  outrages which disgraced the neighbourhood of had ceased after the apprehension of the prisoners.      Waterford Mail, 3 April 1830.
