Samuel is charged at Birmingham court on 22 May 1840 with stealing a watch and is sentenced to 10 years transportation. At the time of his charging, it is noted he has brothers John, Thomas and Henry. Samuel is the son of Thomas and Ann (nee Bailey) Perkins, of Vauxhall Road, Aston, Birmingham. Interestingly, his father lists him on the (6 June) 1841 Census as being at home, but at this stage he was almost 3 months in Australia.
