Colonial Secretary Index. ROAN, Andrew. Per "Isabella", 1822 1824 Mar 26, Jul 27 - On list of prisoners assigned; also listed as Rowan (Fiche 3291; 4/4570D pp.107, 108) 1825 Nov 16 - On return of prisoners tried before the Supreme Court of New South Wales (Fiche 3298; X727 p.13) -------------------------------------------------- Supreme Criminal Court. Before Judge STEPHEN. WEDNESDAY, NOVEMBER 16, Andrew Roan, Timothy Hasty, and John Warwick, were indicted for stealing a wether sheep, the property of Dr. Carlisle, in the district of Upper Minto, on the 25th of September last. James Lindsey, overseer to Captain Campbell's clearing party, in the district of Upper Minto deposed, that in the month of September last, a flock of sheep, belonging to the prosecutor, were depasturing on Captain Campbell's estate. That he was in the habit of mustering the gang under his charge daily, between the hours of 12 and 1 o'clock. That, on the night of the 25th of September, the prisoners, who belonged to the gang, were absent without leave, and being questioned on their return as to where they had been, they stated that they had been amusing themselves in hunting bandicoots. That, in consequence of the conduct of the prisoners, suspicions unfavourable to them were excited, and on the following day a search was made in their hut, when there was found in Roan's dwelling, part of a mutton pie, together with a considerable quantity of sheep bones. That on the same day, the skin and entrails of a sheep were found concealed in a hollow tree which had fallen, and was lying in the bush near to the prisoners' huts. They were quite fresh, and did not appear to have been taken from the sheep above 24 hours. Robert Chaliner, a shepherd in the employ of the prosecutor, deposed, that he had a flock consisting of 212 wethers under his charge, on the 25th of September last; one sheep was missing from the number on the morning following; his sheep-fold is about a quarter of a mile distant from the prisoners' huts; that he has seen the skin of a sheep, which was found in the bush on the same day on which he missed the sheep from his flock, and from its appearance he should suppose it to have belonged to the animal which was missing. Richard Cox, an assigned servant to the prosecutor, deposed, that he saw the prisoner Warwick employed in cleansing some sheep flesh by the side of a stream of water, on the farm to which he belonged, on Monday, the 26th of September; and that he also observed him carry it into his hut. His Honor summed up, and the Jury found the prisoner Warwick, Guilty. Roan and Hasty. Not Guilty.
