Holmes Smith, charged with … stealng, a silver Spoon, two metal tea spoons, and 8 silk handherchiefs, the property of Joseph Gott, was  found Guilty, and transported for 7 years. Halifax Guardian, 4 Jan 1834.  Convicts. — The following Convicts were, on Tuesday last, removed from York Castle, to undergo their respective terms- of transportation : … On board the Gannimede Hulk, at Woolwich, … Holmes Smith, … for seven years. York Herald, 8 Feb 1834. John Holmes was charged with stealing 18 hanks of worsted, four silk handkerchiefs, and other articles, from the house of Joseph Gott of Cowling. On the night of the 24th April last, the prosecutor and his wife went to chapel, and during their absence the house was robbed. A man named Holmes Smith was convicted of the offence at the last Wetherby sessions ; and it was attempted to be shown that the prisoner had been near Gott's house about the time of the robbery and that he had since kept out of the way, but as the proof failed, the court directed an acquittal. Bradford Observer, 3 July 1834.

Holmes Smith was 23 years old, Protestant, single, illiterate, 5'7 3/4" tall, dark sallow complexion, dark brown hair, brown eyes, nose a little pugged, small scar on back of right hand, small wart on back of little finger of same hand, scar inside little finger of left hand. Holmes was born in Yorkshire. 1839: TOL Berrima 24/1/1842: COF 27/5/1844: Married Mary Styles. 1857: He was a goldminer. 1893: He was a farmer. December 1893: Holmes died of Intestinal obstruction, accute peretinitis, and was buried at Heathcote Cemetery on 15/12/1893.
