James Innes and David Thomson, labourers, were then placed at the bar, accused of highway robbery, in having attacked John Shiells, farmer's servant, on the public road, leading from Dalkeith to Pathhead, and having rendered him insensible by blows, took from his person a pocket-book, containing four pounds or thereby, in bank notes. The panels pleaded guilty, and the Lord Advocate having restricted the libel to an arbitrary punishment, they were sentenced to transportation for life.
