Timothy Tooly for a grievous assault on Thomas Gleeson (who was obliged to be carried on the shoulders of policemen to the witness’s chair) deposed that he prosecuted prisoner at the Thurles Petit Sessions, and as he was coming home after making his market, he met Tim Tooly, who told him that he’d pay for what he did—a man named Maher then threw a stone at him. which did not strike him, upon which Timothy Tooly struck witness with ? which broke his leg—witness got up and hopped for about 15 yards, when Mrs, Tooly, (prisoner’s mother) leaped upon him—the witness prosecuted, was brother to prisoner—witness never recovered the injury. Here a piece of bone was presented: Prisoner—On your oath did you not come up to me when I was boxing in the street—catch hold of me, and say, if it was not ble? for him, that you were ? Witness— No, I did not. Guilty—to be transported for seven years. Tipperary Free Press, 26 March 1834.
