On Monday Janet Anderson and John Fogarty were placed at the bar , the one accused of theft, and the other of reset of theft, to which charge the prisoners pleaded, not Guilty ... The Scotsman, 13 July 1822. ------------------------------------------------------ National Archives. Criminal Petitions. HO 17/6/18 1822 Aug; 1822 Sept Prisoner name: John Fogarty. Prisoner details: Former private and army tailor in the 88th Regiment of Foot [Connaught Rangers]. Court and date of trial: High Court of Justiciary, Edinburgh, 8 July 1822. Crime: Reset of Theft from Janet Anderson, namely a pocket-book containing £80 sterling, a gold watch and a snuff box, the property of Mr Buchan, flesher, stolen from him by Anderson while sleeping in a 'house of common resort' in Edinburgh High Street on [8 July] 1822. Initial sentence: 14 years transportation. Petitioner(s): Two petitions from John Fogarty (the convict), supported by two letters of character from his former commanding officers. Alexander Dunlop (convict's counsel). Grounds for clemency: His army service; innocent of the crime; no previous charges or convictions; he is advanced in life and is a married man. Other papers: Judge's report on the case. Additional Information: Charged in conjunction with Janet Anderson who was found guilty of stealing the property and who was also sentenced to 14 years transportation.
