John Banks, a private in the Waggon Train, was indicted for stealing a Promissory 10£. Note from Comet Brandling. Comet Brandling proved to the loss of the Note out of his drawer ; the Note was made payable to witness, who did not put his name on the Bill. Charles Cody, a publican, proved that he got the Note from his wife, and took it to Clonmel, where it would not be taken, as Mr. Brandling’s name was not on it ; that on his return to Caher he went to Mr. Brandling to put his name on the Note, when he (B) discovered he did not pass it. Cody’s wife proved that the prisoner came for change of the Note (which was identified all the parties) and that she gave him six thirty shilling notes, and a pound in silver. Serjeant-Major Ramsline proved that he found six thirty-shilling notes in a hole in the wall behind the manger allotted to the prisoner’s horse —Guilty—but recommended to mercy—sentenced to seven years’ transportation.
