Anthony Barrett, Michael Munnelly, and Henry M'Grath, were indicted for a burglary the house of Thomas Clifford. The prosecutor stated  that his house was attacked by a party of men, after he had gone to bed, they heat him desperately,  and he became insensible—they took away some silver out of his trunk it was in the beginning of June. Biddy Clifford, his wife gave similar evidence, the only person she was certain of having been there is Anthony Barrett—one of them fired a shot —they took three half crowns and Is. 6d. in silver from them, some linen, a bond, and some bank notes. Bridget Clifford, daughter to the prosecutor, stated that she was in bed in the upper room when the men came in—witness went down to the kitchen, and saw the men there—the only one of them she knows is Anthony  Barrett—there were nine others—Barrett had his back to her, and was lighting a candle, and turned round for moment —she might be mistaken in him —they went to the room where her father was, and beat him—she has no less than half dozen sweethearts – did not see Barrett do anything to her father—never saw any of them before —went next day to Killalla and identified him.  Serjeant James, of the police, stated that the wife and daughter of Clifford came to him, and in consequence of descriptions took up several person —Clifford’s house is 10 miles from Killallatook the three prisoners and another man — —the two last witnesses had told him of the outrage, and what had been taken—they identified some, to their belief, and Barrett positively—found in Barrett’s coat pocket 3 half crowns, one shilling and  six pence in silver, and a penny—the woman gave him a saw and chisel which were left behind, and which he now produces. Oliver Clifford deposed that they  attacked his house, which is near the prosecutors’, the same night —they took 45 yards of linen and the  handsaw and chisel now produced. FOR THE DEFENCE. Honor Murphy, a girl almost 15 years old, came upon the table, and being   sworn, commenced as follows—“ By the virtue of my oath Anthony Barrett”— Counsel for the Defence  interrupted her, and told her merely to answer any question, that might be put her—She slept with Barrett, to  whom her sister is married, every night for a week before and after this occurred—he could not have left the house that night without her knowledge. Martin Kilcock lodged in Barrett’s house, and saw them to bed the night the outrage was committed. The jury returned a verdict of Guilty against Barrett, and acquitted the other two.
