FRIDAY, MARCH 29. At 12 o’clock this day John Barry, John Shea, and Patrick Shea, were placed at the bar, charged with having assaulted John Downing, with intent to do him grievous bodily harm so as to endanger his life. After a long and patient investigation which which lasted four hours, the prisoners were convicted, and upon his Worship proceeding to pass sentence upon them in the usual form, after having addressed them at considerable length in the most feeling and energetic manner. Mr. Supple raised an objection that as the indictment was not upon parchment, was not a legal record. The Barrister immediately ordered the deputy clerk of the peace to prepare a fresh indictment upon parchment—had the Grand Jury assembled ; the bills having been found, the petty jury having been re-impannelled, the prisoner had the benefit of second trial. Mr. Supple made several objections which were overuled by his Worship, and they were second time found guilty, and sentenced to seven years transportation beyond the seas.
