Convict Notes
Contributed by Wesley Miller on 4th January 2014 Richard Scadden (father of James) arrived in Sydney in 1819 having been found guilty at the Cornwall Assizes at Bodmin on 4.8.1817 of stealing "one ewe sheep of the price of twenty shillings of the goods and chattels of William Roberts". On trial with him were John Wills and Richard Bath and the three were sentenced "to be severally hanged by the neck until they are dead". I have in my possession a photocopy of the newspaper of the day in which it is reported that the judges reprieved the capital offenders and sentenced them to transportation for life. The trial papers are stored at Chancery Lane, London.
John ?? and Richard Bath were indicted for feloniousiy stealing two wether sheep, the property of James Green. William Spear, bailiff to Mr. Green. deposed that on the 23d of April his master had 14 sheep, which were kept at Launceston; on the morning of that day, witness missed two wether sheep ; he tracked them, and two men, in a marsh adjoining the fold for four or five yards only ; found that a sheep had been pulled over the next hedge, as there was wool on the bushes ; he traced them about six or seven yards in a marsh on the other side of the hedge, and took particular observation of the marks of the shoes;....
