Convict Notes

In June 1857 the High Court of Justiciary heard the case of HMA -V- Mahler & Marcus Berrenhard charged with breaking into a jewellers shop in Glasgow and stealing watches and jewellery valued £2,000. The Legal Report focused on the irregular Police practice by Glasgow Assistant Superintendent Mackay following the arrest of Mahler and the Judicial malpractice by a Sheriff Substitute who was not present during his Judicial Examination. The case against Mahler was 'Not Proven', but Berrenhard was found guilty of reset and sentenced to 6 years penal servitude. - see The Scottish Jurist (1857) Volume 29 pp 562-564 for 15 June 1857 case.
