I have discovered that the 1823 Judgement of Death Act allowed the judge to record a "judgement of death" but then immediately commute it to prison or, in this case, transportation. Much agitation for reform of capital punishment was going on at the time.

According to the Bradford Observer of 10 March 1836, Benjamin Berry was sentenced to death. I am trying to find evidence of a general or royal pardon which commuted this sentence to transportation.

Complexion - Ruddy and freckled Hair - Light brown Eyes - Grey Height - 5' 3 1/2" Scar centre of forehead, mole on front of right side of chin, BB on upper, woman inside lower right arm, BR on upper, man, gun, dog and hare lower left arm, small round scar inside small of right leg.
