MORE ABOUT JOSEPH BERRY: Joseph may well have died in WA, but not before he made a return trip to England -- illegally. Some time before 3 December 1866, he violated the terms of his Conditional Pardon and went back to Liverpool. There he was arrested, tried and convicted at the Assizes for "being at large without lawful excuse before the expiration of a term of twenty years for which he had been ordered to be transported". For this offence, he was sentenced to another term of 20 years' penal servitude (which, in his case, meant transportation, again) "and previously thereto to be imprisoned for one week" (England & Wales, Criminal Registers, 1791-1892 for Joseph Berry; England; Lancashire; 1866). In October 1867, he was back at sea, aboard the convict ship Hougoumont, and bound once more for WA. See his bio at https://convictrecords.com.au/convicts/berry/joseph/70742.

He was single, 5'3¾" tall, light brown hair, brown eyes, fair complelxion, stout build, semiliterate. 11/3/1862: TOL 9/6/1865: CP Comments: Labourer. 1902: Possible death - WA BDM Joseph Berry, aged 73, Born England, parents unknown.
