WEST BRITON, 30 APRIL 1830 – CORNWALL QUARTER SESSIONS – Isacher Binney, a boy 15 years of age, was convicted, chiefly on the evidence of a companion named John Sims, a boy of 11 years of age, of stealing 2lbs of candles from a box belonging to Stephen Michell, a miner in the changing house of Poldice mine, on the night of 10th March. It appeared that on the night in question, these two youngsters were prowling about the mine for plunder and the prisoner seeing an opportunity, went into the changing house, got his hand between the lid and the body of Michell’s box, which did not shut close, and took out the candles. To be transported for fourteen years. 1828-1832 Muster: No 837 – Isachar Binney, aged 15, Burrell 1830, 14 years, assigned to Carters Barrack at Dural as a Government Servant (HO 10/29) 9 August 1832, Sydney Gazette, Return of All Convicts Assigned and Transferred Between the 1st and 30th Days of April inclusive – No. 1269 – Isacher Binney, of the Burrell, stone-cutter, to J.Lamb of Sydney 1837: TOL Parramatta 21/5/1844: COF CONVICTS APPLICATION TO MARRY INDEX: 24 August 1839 – Permission granted for marriage between - Isachar Binney, aged 24, born about 1815, Burrell (1), 14 years, ticket-of-leave holder, assigned to L.M. This Issachar Benney christened 5/2/1815 Kenwyn Cornwall, is the son of Samuel Benney and Alice Sandoe. Not the son of Issachar Benney and Mary Heath.

His surname is actually Benney and his parents were Issachar Benney & Mary Heath. I found that a year before (1929) he was sentenced to one week's solitary confinement and a whipping for stealing approx 2lbs candles. In April 1830, he was convicted of Larceny and sentenced to 14 years, and as he had been previously been convicted of a felony, he was sentenced for transportation to Australia
