Mr. Scott, Q.C , stated the case, and the following witnesses were then examined. John White, Esq., sworn and examined by Mr Scott. Q. I live in Cashel ; I receive rents for several gentlemen; I was in Clonmel on Monday last attending the assizes as a juror ; was proceeding home to Cashel on that evening ; left Clonmel at five o’clock, I was on horseback ; met Mr. Minchin on the road ; he was also on horseback ; rode together for about seven miles before anything particular occurred ; heard a buzz and the report of a shot, the report came from the left side of the road ; the buzz or whiz was the same as the report of shot fired by a soldier at target; it went by the side of head ; there was a gap in the ditch Mr. Minchin was near the gap; we were riding abreast ; on hearing the report, my horse bolted ; I looked around and saw man running along the ditch, he had pistol in his hand; my horse ran about 200 yards before I was able to pull him up ; I then looked out for a convenient place to leap over, in pursuit of the prisoner he was then two or three fields in advance of ; my horse fell twice, but I still continued the pursuit ; I never lost sight of the prisoner until I arrested him with the pistol in his hand (identified prisoner) he ran as hard he could go ; saw Mr. Minchin crossing prisoner in the field ; I said to prisoner, you cowardly ruffian, your shot did not hole me” ; prisoner replied “I’m bloody sorry” I then said ”you did your best,” and he answered he did ; Mr, Minchin came up and assisted me in bringing him to the police barrack ; I receive rents from man named Carthy, in whose employment prisoner is ; this occurrence took place about half mile from Carthy’s house ; it was after six o’clock in the evening ;it was in the South Riding of this county, prisoner wore the same dress on that day that he has on now ; he had rope tied round his waist, keeping his coat up to enable him a good run. Mr, Minchin corroborated Mr. White’s evidence. The jury without a moment’s hesitation convicted the prisoner. Tipperary Vindicator, 25 July 1846.
