CRIME: Administering an Unlawful Oath John Brien was found guilty at the County Assizes of Cork in April 1794 of administering an unlawful oath and was actually sentenced to transportation for life. Four other men given the same sentence for the same crime were, however, never actually transported. A sheep stealer and a house breaker also were not transported. The only other convict from the same March 1794 Cork assizes who arrived in NSW pursuant to his transportation sentence was Daniel Mahony for cow stealing, arrived on same ship. Hibernian Chronicle, April 1794: "JOHN BRIEN, DENNIS SULLIVAN and JOHN KELIHER for feloniously administering oaths. J. [JOHN] ENRAGHTY and WM. MAGRATH, for feloniously causing an unlawful oath to be tendered, all to be transported for life." Also reported in Freemans Journal, indicating sentencing occurred on Saturday 26th April 1794: Freemans Journal, Sat 17th May 1794 p3 "CORK, April 28th Last Saturday [i.e. 26th April] the assizes ended, when the following persons received sentence: IN THE COUNTY: John Brien for feloniously administering an oath, to be transported for life.” NO OTHER RECORD of THIS JOHN BRIEN FOUND
