Joseph Budworth was transported on the Claudine, departing 19th Aug 1829 and arriving 6th Dec 1829 with 180 passengers.

The 'Claudine' was an East Indiaman built in Calcutta in 1811 from teak wood with a tonnage of 452 tons. In 1820 she ran from London to Hobart Town, Sydney, Batavia and back to England. After leaving Sydney on 10 May 1820 under the command of John Welsh, she discovered the Claudine Reef in the Coral Sea, before making her way past Murray Island in Torres Strait on her way to Batavia. The Claudine made two voyages to Australia as a convict transport. Departing Woolwich 24 August 1821 mastered by John Crabtree with Henry Ryan as ship's surgeon. She arrived in Port Dalrymple, van Diemen's Land after a passage of 113 days via Teneriffe, on 15 December, landing 40 convicts. She then sailed on to Hobart Town and landed the remaining 119 male convicts, one prisoner having died en route . On 24 August 1829 the Claudine departed London, arriving in Sydney on 6 December 1829 after a voyage of 104 days; her Master was William Heathorne, the surgeon William H Trotman. On this voyage she sailed with 180 prisoners and their guard; two prisoners died en route. she then sailed on to Madras on 30 December. The Claudine returned to merchant service and on Monday 21-22 November 1840 under the command of captain Brewer was deliberately beached with another East Indiaman 'Westminster' during a storm off the Kent coast near Margate. This stranding was the subject of a famous engraving by William Henry Bartlett and a pencil and chalk sketch by J.M.W. Turner. The 'Westminster' successfully unloaded 6000 chests of tea into two steamers which delivered it to the East India Docks and was refloated on 7 December. 'Claudine' which was beached onshore unloaded into 200 carts the following day 23rd November and was then refloated on a spring tide after 7 December. Both ships having been dismasted in the storm, were repaired and put back into the trade. The Claudine appears to have been sent to the wreckers in 1849.

Budworth; Edwd. Roberts, Thos Jones, Wm. Owens, and Hugh Burns, a notorious gang of thieves, were arrested on Monday se’nnight, and have been since committed for trial at the next Sessions Gore’s Liverpool General Advertiser, 2 April 1829. APPREHENSION OF TWO GANGS OF THIEVES.—We have pleasure in congratulating our townsmen on the prospect of a speedy riddance of two gangs of thieves who have, for some time past, infested the town, but have at length, been entrapped by the exertions of our police. The first of. these comprises five young fellows, named  Joseph Budworth, Edward Roberts, Thomas Jones, alias Craig, Wm. Owens, and Hugh Burns, who have been committed for trial for stealing a firkin of butter from a shop in London-road. Liverpool Albion, 30 March 1829. The Quarter Sessions for this Borough ...The following prisoners have been tried and sentenced: … To  be transported for seven years … Joseph Budworth, 16,… To be imprisoned one year in Lancaster Castle - … Edward Roberts, 18, Wm. Joseph Budworth was born in 1813 in Liverpool, Lancashire, England. In October 1824, Budworth was listed on the County of Lancashire, Liverpool, England, as being tried for the crime of felony. He was sentenced to "6 months and whipped time." In October 1826, Budworth was listed as a prisoner at Liverpool Gaol who had been previously committed and convicted of felony 3 times. This states his name was "Joseph Budworth alias Davis". He was convicted in October 1826 and released on April 1828. On 29 March 1829 in Lancashire, England, Budworth was admitted as a criminal, charged with feloniously stealing one firkin of butter, and sent to the Liverpool Jail. On 4 May 1829 at the Liverpool Court, Budworth was tried for feloniously stealing butter, and at trial sentenced to 7 years transportation to Australia. He had four previous convictions at this time. On 26 June 1829, Budworth was sent to the prison hulk Justita to await his transportation to Australia. On 10 August 1829, Budworth and the other 59 convicts onboard were transferred from the Justita onto the Claudine at Woolwich, England. On 15 August 1829, the Claudine arrived in Plymouth. That evening, another 120 convicts were transported onto the ship. On 24 August 1829, Budworth was transported from London as a convict onboard the Claudine. This ship was an "East Indiaman built in Calcutta in 1811 from teak wood with a tonnage of 452 tons." 180 prisoners and their guards were on this voyage, which was very rough, with two 17 year old prisoners dying on the journey. The Claudine's passenger manifest describes Budworth as following: Age: 16; Education: None; Religion: Protestant; Marriage Status: Single; Employment: Stable boy; Height in feet & inches: 5, 0.75; Complexion: Ruddy much freckled; Hair: Brown; Eyes: Hazel; Marks or Scars: yes. On 6 December 1829, the Claudine arrived in Sydney. Budworth was assigned to work for William Cox, of Clarendon, NSW. By the early 1830s, Budworth had started having children with an Aboriginal woman named Kitty. The 1 June 1842 baptism certificate of their son Joseph shows that Kitty had taken Joseph's last name of Budsworth. It is consequently a possibility they were married, though no marriage certificate has been located to date. 1. Joseph (Junior) Born 27 June 1833. Baptised 1 June 1842 in West Maitland by J. T. Lynch, Roman Catholic. This baptism certificate states the father was Joseph Budsworth and the mother was Kitty Budsworth. 2. James. Born 1840. Baptised 12 August 1845 by J. T. Lynch, Roman Catholic. This baptism certificate states the father was Joseph BUDWORTH and the mother was Aboriginal. 3. John. Born October 1843. Baptised 22 October 1845 by J. T. Lynch, Roman Catholic. This baptism certificate states the father was Joseph Budsworth and the mother was Kitty Aborigini (sic). The parents abode was "American River". The baptism ceremony was performed in the "Parish of West Maitland in the County of Northumberland NSW". 4. Catherine. Born 1832. Her daughter Martha's birth certificate states her mother's name, maiden surname and birthplace was "Catherine", "formerly Budworth" and "Nomby, Tambar Springs". 5. Mary, born 1849. Died 18 May 1878. Mary's death certificate states her father was Joseph Budsworth, and his occupation was 'Laborer'. It states the maiden surname of her mother was 'Aboriginal'. 6. Sarah. Married 24 April 1870 to Frederick George Hamilton. Their usual place of residence is both recorded as 'Bundella Creek'. Died 19 October 1886 in Inverell, NSW. Sarah's death certificate states her father was Joseph. On 15 February 1837, Budworth received his Certificate of Freedom. On 14 March 1859, Budworth "sold to Mr. William Field the Right, Title, Interest, and Brand of all my Cattle, branded EGS ribs or rump, with a split in the off ear, formerly the property of Eugene Griffin; also, all my Cattle branded MGS ribs or rump off side, split off ear. Joseph Budworth (his mark)". On 1 August 1872, Joseph Budworth is recorded as having an area of 40 acres in the Gunnedah District, Pottinger County, Bundalla Parish, Coolah Address. As an "old man", Budworth was still living on the Liverpool Plains. The diary of Mary Jane CAIN states: “After this Bomera Station changed hands a good many times I cannot think what the later hands names are. There was an old man taken a way by the name of Joe Budsworth & an old man Sam Freeman both those men were very feeble but being such faithfully servants & Mr Town’s being so kind hearted it was his wishes for them to go to Windsor his home”. On 30 November 1892, Budworth died at Hawkesbury Benevolent Asylum, Windsor. NOTE: The Hawkesbury Benevolent Asylum was founded in 1818 by Archibald Bell and William Cox, who Budworth had first been assigned to upon arriving in Australia as a convict, 63 years earlier. On 1 December 1892, Budworth was buried at Windsor General Cemetery. A number of family trees, websites and documents have incorrectly stated that Joseph Budworth the convict was actually a man by the name of Joseph Bore, the son of John Budsworth Bore and Margaret Bore nee Woods. In March 2024 this case of mistaken identity was comprehensively refuted by evidence and by the unanimous agreement of independent experts in a WikiTree G2G.

The UK Prison Commission Record from Liverpool Jail for Joseph BUDWORTH shows that he was committed 29 March 1829 for feloniously stealing one firkin of butter, and was 16 years old. The Australian Convict Transportation Register shows Joseph BUDWORTH was transported to Australia on 4 May 1829. The Claudine Muster Roll for 6 December 1829 shows that Joseph BUDWORTH was 16 years old. This indicates that Joseph BUDWORTH was born in 1813. There is extensive evidence that Joseph BUDWORTH had multiple children with 'Kitty', also known as 'Black Kitty'. For example: The 1 June 1842 baptism certificate of Joseph BUDWORTH (Junior) lists his father as Joseph BUDSWORTH and his mother as Kitty BUDSWORTH. NSW BDM 1729 Vol: 62. The 22 October 1845 baptism certificate of their son John BUDWORTH, which lists the father as Joseph BUDWORTH and the mother as Kitty Aboriginal (sic). NSW BDM 2112 Vol: 61. The 11 May 1863 death certificate of Joseph BUDWORTH (Junior) lists his father as Joseph BUDSWORTH and his mother as Black Kitty. 1863/C/23.

Joseph BUDWORTH born 1813, the convict whose profile this is above, is a completely different person to Joseph Budworth BORE born 1811. The UK Prison Commission Record from Liverpool Jail for Joseph BUDWORTH shows that he was committed 29 March 1829 for feloniously stealing one firkin of butter, and was 16 years old. The Australian Convict Transportation Register shows Joseph BUDWORTH was transported to Australia on 4 May 1829. The Claudine Muster Roll for 6 December 1829 shows that Joseph BUDWORTH was 16 years old. This indicates that Joseph BUDWORTH was born in 1813. The baptism certificate of Joseph Budworth BORE (son of John Budworth BORE & Margaret BORE nee WOODS) shows that he was born on 1 August 1811, and baptised on 1 September 1811. The marriage certificate of this same Joseph Budworth BORE, son of John BORE, shows he was a gardener and married Jane HARGREAVES on 8 February 1841. The 1841 census likewise shows that Joseph BORE was a gardener. The 1861 census also shows Joseph B BORE was born in 1811 and his spouse's name was Jane BORE. The source records clearly show that Joseph Budworth BORE was born in 1811. Joseph BUDWORTH was born in 1813. Demonstrably they are two different males with two different names and the records indicate two different birth years. There is zero evidence that Joseph BORE born 1811 ever came to Australia, returned, or was in Australia for one minute. However, there is extensive evidence that Joseph BUDWORTH born 1813 was transported to Australia as a convict, stayed here, had multiple children with 'Kitty', also known as 'Black Kitty'. For example: The 1 June 1842 baptism certificate of Joseph BUDWORTH (Junior) lists his father as Joseph BUDSWORTH and his mother as Kitty BUDSWORTH. NSW BDM 1729 Vol: 62. The 22 October 1845 baptism certificate of their son John BUDWORTH, which lists the father as Joseph BUDWORTH and the mother as Kitty Aboriginal (sic). NSW BDM 2112 Vol: 61. The 11 May 1863 death certificate of Joseph BUDWORTH (Junior) lists his father as Joseph BUDSWORTH and his mother as Black Kitty. 1863/C/23. Consequently all details about the convict Joseph BUDWORTH and his life in Australia are of the male born in 1813, who married Kitty the Aboriginal woman and had six known children with her. They have nothing to do with Joseph BORE who was not a convict and never set foot in Australia.

Joseph's full name was Joseph Budworth Bore. He was first sentenced to six month prison for theft in 1824 aged 13 and his second conviction was seven years transportation to New South Wales. Upon receiving his ticket of leave in 1837, he returned to his family in Liverpool, England marrying a woman named Jane Hargreaves on 8 Feb 1841 and proceeding to have 8 children with her between 1841 and 1860. His crime was stealing a firkin of butter. He later went on to marry Black Kitty and aboriginal from the Warmuli Clan, Darug Nation. Together Kitty and Joseph had 11 children.
