The following Criminal Petition on behalf of 21 year old John Ritchie, gives information about Jane Burgess. National Archives. Criminal Petitions. HO 17/38/189. Date. 1838 Nov 9 – 1842 May 2. Prisoner name: John Ritchie. Prisoner age: 21 years. Prisoner occupation: Slater, formerly a private in the Scots Royals [1st Regiment of Foot]. Court and date of trial: Oxford City Sessions, Oxfordshire, September 1838. Crime: Stealing a coat, and a butter knife, valued at a few shillings, from the shop of Levi Harris. Initial sentence: Seven years transportation. Gaoler's report: Character not known [1838]. Conduct on board Fortitude, two musters bad, the rest good [1840]. Annotated (Outcome): Nil [1838]. Release him at the accustomed time [1842]. Petitioner(s): Catherine Ritchie (mother) of Gallowgate, Glasgow, Scotland, undersigned by William Jaffray. Catherine Ritchie. Catherine Ritchie, undersigned by two others. Grounds for clemency (Petition Details): First offence; led into the crime by Jane Burgess (his co-habitee) and her son (his fellow-convicts); keeping him apart from his confederates will be the only hope of his reform; good conduct since confined; his parents survived their old age only by receipt of a small naval pension until his father died in 1842 and his mother is now in distress; time served on the hulks. Other papers: Two letters from the prisoner's mother forwarding her petitions. Additional Information: Ordered to Fortitude [convict hulk]. Convicted with Jane Burgess and her son [unnamed]. Jane Burgess was ordered to the Planter [convict hulk] and transported to Sydney [New South Wales] and her son was sent to the Penitentiary at Parkhurst, Isle of Wight. Petitioner prays that her son may be sent to Millbank Penitentiary or to Hobart if transported. ----------------------------------------------------------------------- Oxford. On Saturday last the sessions for this city were holden before the Recorder, when the following prisoners were put upon their trial: … John Ritchie, Jane and James Burgess, son of Jane Burgess, a child nine years of age, for stealing a coat, value ?, transported for seven years. ...
