James BURNS (or BURNETT) emigrated to New South Wales, Australia as a free immigrant on the ship 'Moffatt' 1841. On 10 Sept 1845 he was convicted at Maitland, New South Wales for stealing 300 sheep. He was sentenced to a 15 yr transportation sentence and sent to Van Diemen's Land (Tasmania) aboard the ship 'Waterlily' arriving 5 Nov 1845. Aged 23 yrs; farmer's labourer & ploughman; 5'10 1/2" height; fair complexion; sandy hair; Hazel eyes; Protestant; can read & write. Native Place: Chelmsford, Essex, England. Mother: Susan, at native place. 21 months Probation. Station Gang - Dover. 1848: at Fingal 1849: a Constable 1849: assigned to Sir J. Pedder 1851: assigned to Sir J. Pedder 6 July 1852: Ticket of Leave granted.
