Family connections for John (Burns) are: BYRNE John (Byrne/Burns) was born about 1777 & became a gunsmith. He married Elizabeth (William) in Scotland. He was a changekeeper at Falkirk when tried w/his wife & 1other for reselling brandy etc, stolen by 2others on 2 2 1811, at Stirling (probably Stirling Stirlingshire) High Court of Judiciary Scotland on 9 9 1811, sentenced to 14years & arrived in NSW on 9 10 1813 after a voyage of 5months on EARL SPENCER; he was 5'5.5" pale complexion brown hair hazel eyes.>>> [Some details taken from this Website] Elizabeth (William/s) was born about 1769. She was tried w/her husband & 1other for reselling brandy etc, stolen by 2others on 2 2 1811, at Sterling (probably Stirling Stirlingshire) Court of Judiciary Scotland on 9 9 1811, sentenced to 14years & arrived in NSW as a convict with her children on 9 1 1814 after a voyage of 4.5months on WANSTEAD; she was sent to Parramatta-probably with her children. She was issued her Certificate of Freedom no.083/4302 on 22 9 1825. She arrived in NSW with her mother on 9 1 1814 after a voyage of 4.5months on WANSTEAD. She married firstly at age16 William (Dargin) on 8 10 1827 at St Matthews CofE Windsor & produced 1child. ..William (Dargin) was born in 1806. He is recorded in 1828 as Innkeeper/publican at Windsor. She arrived in NSW with her mother on 9 1 1814 after a voyage of 4.5months on WANSTEAD. She married, as Margaret (Burn), William (Waterford his second (2of3) marriage) on 23 11 1829 at St Matthews CofE Windsor. She was living with Samuel (Vaughan) when she died on 7 5 1830 age20 at Richmond & was buried, as (Waterford), at St Peters CofE Richmond. ..[Samuel (Vaughan) was born about 1781 & became a general labourer. He was tried at Warwick Assizes, sentenced to Life & arrived in NSW as a convict on 18 1 1812 after a voyage of 5.5 months on GUILDFORD. He was living with Margaret (Byrne) in 1830. He received permission, on 25 4 1831, to marry Margaret (Grey) and may have done so in 1831 at St Peters CofE Richmond-perhaps his & her first marriage. He died on 17 9 1837 age56 & was buried at St Peters CofE Richmond.] ..[Some details taken from this Website] .. ..William (Waterford) was baptised on 21 11 1799 at Limpsfield Surrey (Smees records suggest birth in 1802). He was tried for uttering forged notes at Kent Lent Assizes, sentenced to death reprieved to 14years & arrived in NSW as a convict on 16 12 1821 after a voyage of 5months on MINERVA; he was 5'6.5" florid complexion eyes brown hair grey eyes. He married firstly (1of3) Mary Ann (Brown/Griffiths her second marriage) on 15 4 1828 at St Peters CofE Richmond Hawkesbury. He was issued his Ticket of Leave on 18 8 1828. He was issued a replacement Ticket of Leave for Hawkesbury on 1 5 1830. He married thirdly Susannah (Merrick) in about 1830. He was issued his Certificate of Freedom in May 1835; on this occasion he had become 5'8.5" fair complexion sandy hair blue eyes. In May 1869 2horses in his possession were impounded. He died on 17 11 1876 age76 after being thrown from his horse at Marotherie Talgbragar River Cassillis District, where he was a squatter, father of 2children. High Court of Justiciary  At STIRLING, Sept. 9. The Circuit Court of Justiciary was opened here, on Saturday last, by the right honourable Lord Hermmand. ... The Court then proceeded to the trial of Anderson, and Janes Menzies, alias Robertson, prisoners in Stirling jail, accused of breaking ?? the shop of James Russel, merchant in Grahamstown near Falkirk, on the night of Saturday the 2Sd of February last, and stealing therefrom a cask of, brandy, two chests of tea, a drawer containing copper coins, and a loaf of sugar, John Burns, changekeeper at Falkirk, Elizabeth Williams, his wife, and Alexander Logan, changekeeper in Denny, were included in the  same indictment, for resetting the said goods, knowing the same to have  been stolen. The trial lasted till Sunday morning, and this day the jury returned a verdict, by a plurality of voices,  finding the libel proven against Anderson and Menzies, but. recommending them to mercy and finding Burns and his wife guilty; and, by a plurality of voices, not proven against Logan. Anderson and Menzies were sentenced to be executed here on the I? th of October next; Burns and his wife to 14 years transportation; ... Aberdeen Press and Journal, 18 Sept 1811.
