Convict Notes

John Callaghan was indicted for stealing five sheep, the property John Collins, and Mathew Sullivan and John Short were indicted for receiving the same, knowing them to be stolen. The Sheep had been stolen off the prosecutor’s land on the night of the of the present month, and on the following day were sold by the prisoner Callaghan in the market of this City to the other prisoners, for which it appeared, they had paid a fair price, and which they had resold at a small profit to other Butchers, with whom they were found. The evidence being clear against Callaghan, he was found Guilty, and being a well known Sheep-trader, he was informed by the Court that his fate depended upon whether the Grand Jury should recommend him as an object of mercy, to which, if they did, he should give due attention. In the mean time it was his duty to record sentence of death against him, and should that be commuted, it would be only on the terms of his being transported from the Country. As to the other prisoners, his Lordship said be considered their case extremely hard ; there did not appear from the evidence any thing to justify their being implicated in the charge, and by his direction they were acquitted by the Jury, bis Lordship expressing bis determination to enquire further into the subject, for which purpose he directed the informations and committal of the Magistrates be laid before him.
