Timothy Callaghan the elder, and Timothy Callaghan the younger, were indicted for breaking into the house of David Fehane—for assaulting Nicholas Fehane with intent to murder him; and also for administering unlawful oaths. David Fehane, lives in Buttevant, recognised Callaghan the younger, as one of five or six persons, who came to his home at night, and broke in the door, pulled down the dresser, and broke all the things on it. They then came to the bed where witness and his brother slept, dragged them out, and half kilt them striking them with scythes and wattles ; they went to the fire-place to look for fire to bum the house with but could not get any, the fire being out. Witness and his brother were then sworn by them to be at work late and early; and to keep secret the next morning what passed that night. The party were not disguised. When witness thought they were gone, they returned and beat him second time. The Callaghans lived in the house witness now occupies before he took it ; and at time of breaking into his house the landlord had some potatoes of their’s in it, which he kept for arrears of rent he claimed. Mary and Nicholas Fehane corroborated the testimony of the former witness. For the defence, evidence was given of there being a dispute between the prisoners and their landlord, about their rent; he wanting them to pay five guineas, by five pounds thirteen and nine pence British. An alibi was also attempted to be set up; but failed as most alibis do. On account of there being property claimed by them the house which they broke in, the Chief Baron was unwilling that the prisoners should be found guilty of burglary —for same reason too, he thought, they ought not to find on the capital indictment, for an attempt to kill Nicholas Fehane—it would be sufficient, they found them guilty of administering unlawful oaths. The jury brought In their verdict accordingly. Waterford Mail, 29 Aug 1827.
