Convict Notes

Robert Capon was one of two defendants convicted of stealing at his trial. The other, John McGinnis, was also sentenced to transportation for 7 years but he died in a London gaol.

There is a judges remark at the end of the trial record. The case led to a guilty verdict on the lesser crime of stealing not the original charge of house-breaking. The judge thought it important to point out to magistrates charging thieves that the case wasn't serious enough for a house-breaking charge. (It was sneak thieving items from an unoccupied room.)
