Family connections for Charles (Martin) are: Some amendments added Jul 2025. MARTIN Charles/Charley (Martin) was born about 1796. He was tried for highway robbery of Richard (Coster) & stealing watch etc nr Newington Surrey at Kingston on Thames Lent Assizes Surrey & sentenced to death-later reprieved to Life. He assaulted his accuser, who may have died, while in custody near the court, tried, sentenced to Life, held on hulk LAUREL & arrived in NSW as a convict with 2Life sentences on 31 12 1818 after a voyage of 5.5months on GENERAL STEWART [Smees records show him arriving in 1813 on GENERAL HEWITT]. He was assigned to a road party & later was employed by William (Cox). In 1821 he was convicted for embezzlement of Government lime at Windsor & sentenced to 1year gaol; he was sent to Newcastle prison on ELIZABETH HENRIETTA on 30 11 1821. He married with permission Ann (Forrester her second marriage) on 8 4 1822 at St Matthews CofE Windsor. He was Free by Servitude by 1822. He was recorded in 1824 as a landholder & in 1825 as a sawyer. He is recorded in 1825 assigned to his wife. He is recorded in 1827 as a farmer. He is recorded in 1828 with his family as a brickmaker at Wilberforce. He is recorded on 30 9 1828 in Windsor gaol unttil 7 10 1828; he was 5'7" fair ruddy complexion brown hair hazel eyes. He was recorded in 1830 as a farmer. In 1834 he is recorded as sawyer at Wilberforce & was issued his Certificate of Freedom for Windsor on 29 11 1834. He is recorded living in Sydney on 7 10 1838. He died, as Charles Horner (Martin), on 11 6 1886 age91 at his home Freemans Rd Pitt Town/Windsor & was buried at Wilberforce Hawkesbury city. 1818 Age 22 Highway Robbery Charles performed "A robbery on Richard Coster and taking from his person goods to the value of 5 pounds 6 pence. A watch, a seal, a key and a ribbon in open space near the highway in the parish of St. Mary. Newington, Surrey, England Mar 20 1818 1818 Age 22 Trial(1) He was sentenced to Death. This made Charley very unhappy. On his way back to prison he observed Constable Smith, who's evidence convicted him. As Charley walked past him, he struck him a dreadful blow on the temple. Lent Assizes for Surrey, Kingston on Thames Mar 30 1818 1818 Age 22 Trial(2) Smith fell, apparently dead. The Judge hearing of this ordered Charley back to court and further sentenced him to another life sentence. Mar 30 1818 1818 Age 22 Commuted Charles two life sentences were commuted to transportation "for and during their respective natural lives" London, England Apr 21 1818 1818 Age 22 Placed on Board Charles was transferred to "Laurel" a prison hulk. Sydney Morning Herald Wed 16 June 1886, Page 1: Martin, Charles: June 11 at his residence, Freeman's Reach, Windsor, Charles Homer Martin, aged 91, beloved father of Mrs James Graham, Bartlet Terrace, Green's Road, Paddington, leaving an aged wife 12 sons and daughters, 91 grandchildren an unknown number of great grandchildren. Beloved and respected by all who knew him.

Charles married Ann Forrester in 1822. Ann was the daughter of Robert Forrester (Convict, Scarborough, 1788) and Ann Ramsay (Convict, Lady Juliana, 1791). It would appear that Charles was assigned to Ann as a convict worker, and we can find him listed as such in the 1828 census - [Ref: M1928] Martin, Charles, 32 GS, General Hewitt, 1818. #Note this is an error Should say 'General Stewart'. Also listed are Ann, as landholder and three children. Ann and Charles had 12 children.
