Convict Notes

TUESDAY, 14TH AUGUST. Patrick Goodman was indicted on a charge of sheepstealing; and Bryan Spalding, and Charles and Mary Walsh, as accessaries after the fact. Joseph Harper of Windsor, deposed, that in March last, he had a number of Sheep in an enclosed stock-yard in that town;—that on the 27th of that month he was informed, that the head, skin, &c. of a sheep were found in a paddock, belonging to Mr. Denham; and that on examination he recognised them as having belonged to a very remarkable sheep, then missing from his flock, and which he could identify among ten thousand. This testimony was corroborated by that of Mr. Joseph Harper, jun. John Scully, an approver, deposed, that in March last, he was a Government Stock-keeper at Windsor,—that he occasionally called at Spalding's house, in which Charles and Mary Walsh also resided;—that the prisoner Goodman frequented the same house; that in the latter end of March, he accompanied Goodman to Windsor, whence they conveyed a sheep from behind the Chapel, to Mr. Denham's paddock, where Goodman cut it's throat, and deponent skinned it; they then divided it, and brought it to Spalding's house. The parties present, Charles and Mary Walsh, were cognisant of the fact, to whom the Sheep had belonged, which witness divulged to them. This testimony was borne out in some points, by other witnesses, as far as it related to Goodman. The Chief Justice, in summing up, left the case, as respecting the accessaries in particular, to the consideration of the Jury; as their criminality rested entirely on the degree of credit, which might be attached to the testimony of the Approver. A Verdict of Guilty was returned against all the prisoners. The Gleaner, 18 Aug 1827. -------------------------------------------------- Legislative Council. Tuesday September 4. The following pensions were then voted last year : Mr. Joseph Harper, late Master of the Public School, Windsor, £50. Sydney Gazette, 6 Sep 1838.
