John Carroll, Michael Coghlan, and Thomas Sheehan, were indicted for burglariously entering the dwelling, and feloniously stealing a desk and valuable articles and money, the property of Mr. Wm. Williamson. The house of Mr. Williamson had been entered after he had retired to to rest, through window to which a ladder had been placed, and the articles carried off, which were afterwards found in the prisoners possession, by Mr. Sheriff Wallis, and some the Peace Officers. The Court did not consider the evidence sufficient to establish the charge of burglary, Mr. Williamson not being able to say whether it was before or after day-light the house was entered, and the prisoners were acquitted on that count; but the felony was clearly proved, and they were convicted, and sentenced be transported for seven years.
