Constable John Johnston was convicted of Darlington's manslaughter & sentenced to 7yrs transportation. The constable confronted Darlington in Morpeth on 9 March 1840 as Darlington was slightly intoxicated & arguing with his fiancée. Constable pulled a pistol which he held to the deceased's back when it discharged. Darlington died 4 days later.
