David McLelland was found guilty of going armed illegally into the bush around the George's River and committing robbery under arms on the Liverpool Road He was captured with several accomplices on the Windsor Road. One of the accomplices James McKinnon turned Approver in accepting his part in the more minor theft of items from an Orphan's Cart. The judge recorded a verdict of death to David McLelland, but his accomplices William Oates, John Cunningham, James McKinnon, and another man not named, returned a verdict of Not Guilty from the jury.
