He re-enlisted in Agra on 25th August 1828 for 5 years and then re-enlisted again 17th July 1834 for 5 years. His parents are listed as European and he was Transported for Life to New South Wales by sentence of General Court Martial 8th August 1837. His crime was committed 11th May 1837 when he maliciously stabbed with a bayonet, in the chest and other parts of the body, acting Corporal George Ritchie. His Sentence: The court on the evidence before them, are of the opinion, that the prisoner is guilty of the charge preferred against him and sentence him accordingly to be hanged by the neck till he be dead. Recommendation by the court: The Court have performed the painful part of its duty in passing the above sentence of death on the prisoner, but it appearing that premeditated malice did not actuate the prisoner to the commission of the crime of which he has been found guilty, beg most respectfully to recommend him to the clemency of the Excellency the Commander in Chief. On the above recommendation of the majority of the members of this court martial I remit the sentence of death passed against the prisoner, and order that he shall be transported beyond the seas as a felon for the remainder of his life, signed: H Fane General Commander in Chief. On 30th June 1837 the Right Honourable Governor General of India concurs in the foregoing communication of a sentence of death to transportation beyond the seas, as a felon, for the remainder of his life, passed on Private Patrick Duffy, Grenadier Company European Regiment. Patrick Duffy pleased that he was mad, from often repeated and excessive drunkness. The infirmity of mind arising from that cause, is his only excuse, yet the court has been induced to recommend him to mercy. Patrick Duffy had a sister who was married to Sergeant Baxter.
