Foley, John Farm servant aged 22 from Queens Co. Tried in Queens County in 1832 and sentenced to transportation for life for assaulting a dwelling (whiteboy crime). Brother Edward Foley age 24 convict of the same crime. John was assigned to Thomas Pendergrass at Maitland in 1837. Granted Ticket of Leave for Maitland in August 1841. Ticket of Leave cancelled in January 1843 for driving cattle from their run and extorting money from the owners.

Born in Laois (Queen’s County), Ireland, John was a farm servant and convicted alongside his older brother Edward of assaulting and levelling a dwelling, as well as being part of a secret Irish agrarian organisation known as The Whiteboys. His brother Edward ‘Ned’ Foley was an active participant and perpetrator in the Myall Creek Massacre, of which he was hung for his crimes of murder and brutality against the Aboriginal people. Edward was a convict stockman assigned to John Henry Fleming’s older brother, Joseph, at Mungie Bundie at the time of the atrocity. John was assigned to the Maitland area. He received a Ticket of Leave on August 8th 1841 on condition he stay in the Maitland district. It appears this was cancelled due to John driving cattle away from the area they were meant to be in. John then received a Conditional Pardon in 1847. John married Irish immigrant Mary Ann Moore at Wollombi on April 24th 1848. This union produced 10 children. John passed away August 24th 1878 at Wollombi.
