High Court of Justiciary. MONDAY - JANUARY 13. This morning Alexander Fraser was put to the bar, and an indictment read against him charging him with five different acts of falsehood, fraud, and wilful imposition, by going into different cloth-merchants' shops, in the city of Edinburgh when the proprietors were absent and producing a pattern of cloth, and pretending that came from some neighbouring cloth-merchant, cozen and impose upon the shopmen and apprentices, and carry off quantities of cloth. Tile pleaded guilty to the first, fourth, and fifth charges in the indictment, and having adhered to his confession in presence or the Jury, they found him guilty accordingly,  in terms of his judicial confession. Mr Brodie, as Counsel for the prisoner, addressed the Court shortly, in mitigation of punishment, and read certificates of his character from his late master, and stated, that  he was driven to commit the acts which had been found guilty, entirely from necessity. The Court having  shortly consulted among themselves, and their Lordships delivered their opinions, the Lord Justice Clerk. alter suitable admonition to the prisoner, a young man about twenty years of age, sentenced  him to transportation beyond seas for the space of seven years. He was tried for stealing at Edinburgh Court of Justiciary, sentenced to 7years & arrived in NSW as a convict on 5 4 1818 after a voyage of 6months on BATAVIA; he was Protestant; he was assigned to Rev. Henry (Fulton) at Christ Church Castlereagh & employed at Glebe schoolhouse. He married as emancipist Lydia Margaret (Fulton) on 8 10 1827 at Christ Church Castlereagh & lived on 60acres near to Glebe. He was recorded in 1828 as a clerk & in 1830 as a settler, He became Clerk of Court in Penrith courthouse & first Penrith Postmaster. He became scretary of Bridge Building Committee for building of first bridge over Hawkesbury River & secretary of MUIOOF (Oddfellows/Freemasons?) Lodge. He was recorded in 1828 with his wife as Clerk to the Bench in Evan district. Lydia Margaret (Fulton) was born in colony Christ Church Castlereagh in 1805-recorded in Sydney 1928 & 1930. Their children were James Fulton & Ann Lydia born 1828 & 1830 Christ Church Castlereagh as well as Magdalina .




I have a photo of Alexander Fraser & one of his wife,Lydia (nee Fulton)taken probably in the late 1850s. N.B. On checking what I wrote in my earlier comments I noted an error regarding Alexander's father's. He died in 1809.




Alexander Fraser is buried in the old Anglican Cemetery at Castlereagh near his wife, Lydia,his son, Henry Alexander & daughter Madelina as well a number of other family members (all in a wrought iron fenced plot). Nearby there are the tombs of a number of other relatives of his wife Lydia, including her father, the Rev. Henry Fulton & her mother Anne as well as her brother John Walker Fulton & her brother-in-law, John MacHenry.




On arrival in Australia he was assigned Rev Henry Fulton at his Church at Castlereagh where he was employed at his Glebe Schoolhouse. In 1827 he married Henry Fulton's daughter Lydia, & they had 10 children & lived a a small farmer (60 acres nearby). Alexander became the Clerk of the Court in Penrith Courthouse as well as the first Postmaster. He was secretary of the Bridge Building Committee thyat built the first bridge over the Hawkesbury River & also secretary of the MUIIOF (Odd Fellows Lodge) which assisted with the medical work in the district. His parents were James Fraser & Magdelina Anderson of Edinburgh & he had an elder brother, John. FRom what I can gather his father died in 1709 & his mother in 1818. One of Alexnder's daughters, Magdelina, died aged 5 in 1845 while all but one of the other children married. There is much more, of course, if you wish to use it. Regards, John Fraser
