He was a dustman when tried for stealing, on 8 11 1874, a great coat etc of Henry Martin (Bird) at Old Bailey on 8 12 1784, sentenced to 7years, held at London Gaol Delivery & hulk CENSOR at Portsmouth from 24 2 1787 & arrived in Port Jackson via Botany Bay NSW as a convict on 22 1 1788 after a voyage of 12months on First Fleet ship SCARBOROUGH. He became a constable in The Rocks area. He married Mary (Williams) on 14/24 2 1791 at St Phillips CofE Sydney Cove. He was Free by Servitude by 1795. She was tried at Monmouth Assizes, sentenced to Life & arrived in NSW as a convict on 26 6 1790 after a voyage of 7months on Fleet ship NEPTUNE; a voyage noted for extreme brutality of prisoners with a high death rate. She was Free by Servitude by 1798 (although the sentence was Life). She died on 24 12 1805 age38 & was buried at St Phillips CofE Sydney. He died on 13 3 1796 age2 (Smee has 17m) & was buried at St Phillips CofE Sydney. 3.Mary (Humphreys) was born on 7 9 1794 & baptised on 10 1 1795 with Edward at St Phillips CofE Sydney. She married Thomas (Gosper) on 19 4 1819 at St Matthews CofE Windsor & produced 6children. She died on 24 1 1892 age97. ..Thomas (Gosper) was born on 12 7 1798 & baptised on 18 10 1798 at St Phillips CofE Sydney. He purchased 50acres at Upper Colo from Richard (Reynolds). He was recorded in 1823 as a settler, in 1824 as a farmer & 1825 as a settler. By 1828 he had become a farmer at Lower Portland Head. He was recorded in 1828 as a farmer & in 1830 as a District Constable. She married John (Turner his first (1of3) marriage on 21 3 1825 at St Thomas CofE Port Macquarie & produced 4children. She was recorded in 1828 as housekeeper at Harrington St Sydney with 3children. She died on 9 8 1830 age35 mother of maybe 4children. .[noted a Mary Ann (???) was born to Elizabeth (Humphrey born in colony 1796) & ??? (???) defacto in 1815] ..John (Turner) was born about 1793 & became a blacksmith. He was native of Liverpool, a coloured Mullato, when tried w/1other at Somerset Quarter Sessions, sentenced to 7years & arrived in NSW as a convict on 11 10 1816 after a voyage of 5months on MARINER; he was 5'4" dark brown complexion black hair black eyes. He was issued his Certificate of Freedom in February 1823. On 22 9 1823 he was tried for obtaining goods under false pretences w/1other of George Jackson (Frankland), sentenced to 7years & sent to Port Macquarie Penal Settlement as a convict with wife & child on LORD NELSON. He was still a blacksmith in 1827 & was tried again at Sydney Criminal Court on 24 7 1828, sentenced to 3years & sent to Moreton Bay Penal Settlement on BAMBOO on 30 8 1828. He married secondly (2of3) with permission Ellen (Ham/mer her first marriage) on 11 3 1831or3. He moved to Tasmania after 1840 & married thirdly Mary Ann (Bennett). Baptised on Jan 2 1766 at St Pauls Deptford, Kent, England Edward was caught on 8 November 1784 carrying out a pair of leather boots and a great cloth coat from the house of Martin Bird. Trial: Old Bailey, on 8 December 1784. Sentenced to 7 years, transportation. After the trial he was transferred to "Censor" hulk on Thames River from Newgate Prison on 23rd May 1785, then transferred from "Censor" hulk to Portsmouth on 24 February 1787. After three days journey on foot to Portsmouth, Edward embarked on the "Scarborough" on 27 February 1787. He arrived at Port Jackson, after Botany Bay stint, on 26 January 1788 to serve his sentence. He was a constable in The Rocks area. Married Mary Williams (convict) on Feb 14 1791, Sydney. They had 6 children. Died Nov 4 1804 Death Certificate 1925-2A/1804 Buried at Old Sydney Burial Ground (now under Town Hall)




Mary [Ref AF733] and Edward [Ref 741] are both recorded in the 1802 Muster, but no details of relationships of family are mentioned. Mary and Edward lost 1 child in 1796 but otherwise the family prospered until 1804. Then in a matter of twelve months, both Mary and Edward died. Neither are recorded in the 1806 Muster or any further records. One wonders what happened to the little family. 2 boys and three girls, aged from 12 years to 1 year when the parents died. How did they survive? Well survive they did! In the 1828 Census of New South Wales we can find.... [Ref H2850] Humphreys, William aged 33, BC, a shipwright at darling harbour. [Ref T1289] Turner, Elizabeth, 32, BC. A housekeeper at Harrington Street, Sydney, 3 children. # Her husband John is in gaol! [Ref G0825] Gosport, Mary, 27, BC. With her husband Thomas, a farmer at Lower Portland Head, 4 children. [Ref P0390] Payton, Susannah, 25, BC. With her husband Nathaniel at Parramatta, 3 children. There is no mention of the other son, Edward, he was a seaman so possibly was away at the time.




Edward was transported as part of the First Fleet, aboard "Scarborough". In the colony, he married Mary Williams (Second Fleet Convict, Neptune, 1790) February 14th 1791 at Sydney Cove. Edward and Mary had 6 children between 1791 and 1803.




Old Bailey Online: Transcript t17841208-92 - EDWARD HUMPHREYS, Theft - grand larceny, 8th December 1784. EDWARD HUMPHREYS was indicted for feloniously stealing, on the 8th of November last, one cloth great coat, value 30 s. one pair of leather boots, value 10 s. the property of Henry Martin Bird , Esq. The prisoner was stopped by Nathan Nathans , with the great coat and boots; and Sarah Biggs deposed, on the 8th of November she let the prisoner into her master's house, as a dustman, but did not miss the things till they were brought back. (The things deposed to.) PRISONER's DEFENCE. A gentleman asked me to carry them, he had a sack on his head. The Prisoner called three witnesses, who gave him a good character. GUILTY . Court to Prisoner. This is a second instance that has occurred this Sessions, of dustmen robbing houses; it is an offence particularly dangerous, because the credulity of servants is imposed upon by those that come under that pretence, they come into the house under a trust; I think it therefore necessary, for example, to pronounce sentence upon you before you quit the bar, in the hearing of those who have heard the trial, and that sentence shall be as severe as the law admits in such a case; which is, that you be Transported for seven years.
