Convict Notes
About 7pm on Tuesday 24 December 1844, a trunk with clothing, groceries and spirits was stolen from a Carrier cart in the Grassmarket. Edinburgh Police Sergeant-Major John Kelly Criminal Officer John Fallon investigated and shortly apprehended 'two notorious offenders McGuire and Burn, lately liberate from Perth Penitentiary' in a house at Close, Grassmarket. The keeper of the house, wife and 3 of the family were also apprehended for reset. After appearing at the Police Court, it was reported that the seven accused have been remitted to a higher Court - see Scotsman newspapers 28 December 1844 p 3 under 'Other1-NoTitle'. In March 1845, the accused James McGuire and James Burns appeared at the High Court of Justiciary for the theft in the Grassmarket. McGuire pleaded Not Guilty and his case was deserted pro loco (but no trace of any other report). James Burns pleaded guilty and received transportation of 7 years - see Scotsman 12 March 1845 p 3 on 'High Court of Justiciary'.
