James had a petition submitted by the Curate of Brasted, Sevenoaks on the 9th May 1848 in which the Curate, Henry G Brasnell, submits the case for consideration on the grounds of the severity of the sentence. The curate states that James was a man of “industrious and sober habits” and that the sentence “does appear to me and other highly influential persons a great deal too severe, as it is the first conviction for that offence”. James died in Perth, WA in 1899
