Edward James was transported on the Surrey Or Surry, departing 9th Apr 1834 and arriving 17th Aug 1834 with 262 passengers.
Built at Harwich in 1811 a square-rigged transport ship of 443 tons and copper lined she had two decks with a height between decks of 5 ft. 8 ins. In 1818, she had a major refit increasing the decks (and convict carrying capacity) to three. She was owned by the London firm of F. & C.F. Mangles.

Tried at the Old Bailey, 17 October 1833. 1459. EDWARDÂ JAMESÂ was indicted for stealing, on the 19th of September , 1 wine strainer, value 1l. 10s.; and 4 salt spoons, value 8s. , the goods of John Gale . CAROLINE ANN GALE . I am the daughter of John Gale , he lives at Newington ; I have known the prisoner ever since he was three years of age - he has visited at our house - he is not related to us; I don't think he had done any thing; but his father is a wine merchant; on the 19th of September, he came to our house about three o'clock, and said Mr. Gale had sent him to wait there till five o'clock; he was shown into the parlour - I went down and staid there ten minutes or a quarter of an hour - I then went out of the room - I heard him walk across the room, and go out at the door; I then went into the parlour, and missed the property stated from the sideboard in the parlour - I gave information directly. HENRY RACKHAM (police constable N 184). I was on duty, and took the prisoner in Kingsland-road, between three and four o'clock; I asked him what silver he had been stealing, he said, "I will give it up to you;" and he gave me this. Crime: Stealing four spoons etc. Initial sentence: Seven years transportation. Gaoler's report: 'Character unknown, connexions respectable'. Annotated (Outcome): 'Answered 6 December 1833' [a further annotation is present, 'Ordered to the' in ink with the word 'penitentiary' in pencil incompletely erased]. Petitioner(s): [illegible] James (father) [Lieutenant H P 69th Regiment]. Grounds for clemency (Petition Details): None; the petition prays that the sentence be carried out and his time be not served on a prison ship in this country. Additional Information: Petitioner refers to his unanswered previous application dated 25 October 1833 [not present].
