John Down was sentenced to 7 years transportation for larceny on 17 May 1853 at trials held in Exeter Castle, Devon, England. I cannot find a ship showing his name for passage in the listings here but he did arrive in Australia and actually died at Port Fairy, Victoria in 1933. I am currently trying to find out more about John Down as he was my wife's 2nd great grand uncle.
