The Sydney Gazette and NSW Advertiser Thursday 11 November 1830 states that following - Bathurst 30 October 1830 Special Commission (Before his Honor the Chief Justice and a Jury of Military Officers). Robert Webster (Grenada), James Driver (Lady Melville), Dominic Doley (Ferguson) and John Kenny, were indicted for stealing from the dwelling-house of John Brown, at Dunn's Plains on the 6th September last, various goods his , and putting the said John Brown (being therein) in bodily fear. The three former prisoners, Entwistle (John), Gahan (Eliza) and Gleeson (Larkins)were included in this information but not arraigned. The prisoners, in company with several other men, armed, came to the farm of the prosecutor on the day in question and enquired for the overseer, who had previously been sent out of the way by his master, in consequence of information that there was a bad feeling existing against him on the part of the prisoners. The overseer not being there, the prisoners (with others proceed to take what articles they wanted, and left the farm without offering violence to any person there. The prisoners were captured with part of the property in their possession, and were all identified as being of the party at the time. The Jury found them all Guilty, and sentence of death was passed and execution awarded on the 2nd November. They were arraigned upon another indictment, charging them, together with Entwistle, Gahan and Gleeson, with a similar offence committed at the farm of Mr Sealey at Dunn's Plains on the 26th September 1830. The Government Gazettes dated Tuesday 5 October 1830; 12 October 1830 and Thursday 21 October 1830 in the list of convicts that have absconded that Kenny John, 29-124, Governor Ready, 22, Carter, County Cork, 5 feet 4 inches, hazel eyes, brown hair, ruddy and pock pitted complexion from Mr Liscombe of Bathurst, charged with murder. Government Gazette Thursday 4 November 1830 was apprehended in the previous week.

The Convict Indentures state that John Kenny was 21 years old. He could neither read or write; religion Catholic; status married with 1 child and a native of Cork City. He was a carter. He was convicted of robbing a person on 19 April 1828 at Cork and sentenced to 7 years. He had no prior convictions. Physical attributes - height 5 feet 4 inches; complexion ruddy and pock pitted; hair brown and eyes hazel. Transport number 124. Assigned to Mr John Liscombe, Bathurst NSW.
