John & Ben Burrell together with Thomas Sharpe appear in the Glebe Burial Register for 30 April 1830. Joseph Savage is not in the burial register, but Catholic Priest John Therry recorded death 1 May 1830 in St Mary's, Sydney register. Therry recorded attending the execution of 5 men at Maitland in 1830, which would suggest Kearney was one of the 5 and this is consistent with Sydney Gazette of 6 May 1830. Kearney appears in no other record after this date. In all likelihood he was executed at Maitland on 30 April 1830 and buried with the others in Glebe Cemetery, Maitland.

20 April 1830 Kearney was tried at Maitland for the highway robbery of Alexander McBean at Wallis Plains on 15 November 1829. Sentence of death and judge then ordered his execution.
