ENNIS ASSIZES, AUGUST I. Michael Madigan, Michael O’Neal, Thomas Linnane, Daniel Kelly, John M’Namara, (Hugh) William Chambers, Patrick Degidan, John Kelly, Murtogh Kelly, Daniel Dixon, Luke Madigan, Michael Fox, and John Madigan, were severally indicted were severally indicted, for aiding and assisting one James Doyle in the wilful murder of Michael Cleary, at Labasheedy in February last. It appeared from the evidence, that on the day laid in the indictment, which was Sunday two parties, called the Macgraths and the Birminghams, to the amount of persons, had desperate conflict at Labasheedy, from six o’clock in the morning until about one, during which a man, named James Doyle, rested a firelock on mud wall, in the morning until about one, during which a man, named James Doyle, rested a firelock on mud wall, presented it and fired, and instantly the deceased, Michael Cleary, fell, and died in about one minute after being shot. Others were armed with sticks, stones, &c. The prisoners belonged to the Macgrath party, and had their party chalked. The jury retired for about quarter of hour, when they returned, acquitting Michael Fox and John Madigan, and finding all the rest guilty of manslaughter. Five were sentenced to transportation for seven years the other six, to one year’s imprisonment. Belfast Commercial Chronicle, 13 Aug 1827.

He was sent to “M Dixon, Sydney” 1828 CENSUS: Daniel Kelly, Catholic, age 26, 7 years per “Borodino” 1828, GS, Miller to john Dickson and residing at Darling Harbour. Mr Dickson had been in NSW since 1813 and brought with him a steam engine which he ran at Darling Harbour on a 13 acre grant. The steam engine was solely used by him for milling grain. By 1828 he also had a brewery and a soap works near the steam engine. He sold the steam engine in 1833 Dickson also had large land grants, the first of whih wsa t Bringelly. He must have sent Daniel Kelly out there because his ticket of Leave ws for this district: TICKET of LEAVE 32/0952 Dated 2nd May 1832; Allowed to remain in the District of Bringelly; Daniel Kelly Place of Trial: Clare. Daniel KELLY at age of 26 years was found guilty of manslaughter, at the Ennis Assizes at County Clare on 3rd August 1827, and transported for 7 years on “Borodino” arriving NSW in June 1828. From Indent: *could read and write. Catholic. Single. * no prior convictions. * Native of Co Clare, Farm labourer. * 5ft 3& 1/2” tall, Red and much freckled complexion, Brown hair and hazel eyes. * Disposed of from ship to John McArthur at Camden.
